From January 2011, this Statement on the Protection of Personal Data issued by Silver Sail is applicable in accordance with the General Data Protection Regulation. All Silver Sail group companies that can be used for the purpose of data gathering are covered by this policy.

Silver Sail shall process your personal data in accordance with Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and national laws based on the said Regulation, with the application of appropriate technical and security measures for the protection of personal data against unauthorized access, misuse, detection, loss or destruction.

1. General information

This declaration shall describe what data you may be collecting, the way in which they are processed and how it will be used by us; as well as your rights with regard to those data.

This is the processing of your personal data by order, in which case we shall also be responsible for the protection of your personal data, when we use the services of external providers to process your personal data.

2. Types of personal data we process

We use the following personal data:

  • Master data: surname and first name, date of birth, country of residence, nationality, personal identity number or tax code.
  • Data on addresses and contact information: city, e mail address, cell phone number
  • Other data: type of identity document, number of an identity document, date of boarding, port of boarding, name of yacht or boat, number of skipper license, number of VHF license, credit card number, booking number, GPS coordinates of navigation

3. Legal basis and purposes of personal data processing

All types of your personal data are processed based on:

  • Legal obligations: We process your personal data in accordance with the regulations in force, as well as for the purposes of notification and registration which we are obliged to perform in accordance with the regulations in force (e.g. the Ordinance on the conditions for conducting the activity of chartering of vessels with or without crew and the provision of guest accommodation services on vessels, concluding an agreement on the provision of chartering of vessels).
  • Fulfillment of agreement: We process your personal data for the purpose of fulfilling the agreement and contractual obligations we have concluded.
  • Consent: for the purposes of assessing satisfaction after a charter term and to contact you,you have given your consent by providing us with data which will be processed in connection with transmission of advertising offers or additional information relating to business.
  • Legitimate Interest of the Controller: All your data is processed for the purpose of meeting the obligations of the legislative body (e.g. Ordinance on the conditions for conducting the activity of chartering of vessels with or without crew and the provision of guest accommodation services on vessels) or for fulfilling contractual obligations and concluding agreements, e.g. Agreement on the provision of vessel chartering.

We use personally identifiable data from our customers in person, at fairs, through websites, e mails or telephone calls and are also receiving them from a number of chartering agencies.

4. Retention period

As a general rule, we will delete your data after you have terminated the contract and at the end of any applicable legislative requirement for their retention.

5. Consent management

At any time, you may withdraw your consent. Also, you can object to our processing of your data at any time.

We shall no longer use your information for the purposes referred to above if you revoke this consent. You may consent for a second time if you wish.

If you do not provide us with the personal data we need to process your personal data without your consent in order to conclude an agreement with us, carry out the agreement once it has been concluded, or fulfill legal obligations, we will not be able to fulfill our contractual obligations to you or enter into an agreement with you.

6. Rights of data subjects

  • Right to have access to and information concerning the handling of personal data i.e. the controller shall process data subjects' personal data or not and what, if any, purpose this processing may be for, categories of personal data in question etc.
  • Right to rectification: You may request that we correct or complete these data at any time when they are processed for the purposes of processing your Personal Information, which is neither complete nor accurate.
  • Right to erasure: If we process your personal data unlawfully, or if that processing makes it unnecessary to protect your protected interests, you can request the deletion of this information. Please bear in mind that it is not possible to delete immediately for some reason. This is because of the obligation to keep records, as set out in law.
  • Right to data portability: You may ask us to provide you the data you have entrusted to us in a structured form, in a standard machine-readable format:
    • If we process these data on the basis of consent you have given us and which you may revoke or for the fulfillment of our agreement and
    • if the processing is done using automated processes.
  • Right to object: If we distribute your information for the purpose of performing a public interest task or a task of public bodies, or when upon the processing of your information we invoke our legitimate interests, you may file an objection against such data processing if there is an interest in protecting your data.
  • The right to object to the competent authority: You should contact us to deal with any problems if you think we are in violation of the Croatian and European Data Protection Regulations when processing your data. You have the right to lodge a complaint with the Croatian Data Protection Authority, or in the event of a change in the applicable legislation, with another authority which will assume its responsibility, and from 25 May 2018 with the supervisory authority of the European Union.
  • Exercise of rights: Contact us by means of your contact information provided for in the first paragraph of this declaration if you would like to exercise any of these rights.
  • Identity confirmation: If there is any doubt, we can ask for further information in order to verify your identity. It's for the protection of your rights and private life.
  • Misuse of rights: We may charge you administrative fees or refuse to process the request if you use those rights too often and with clear intent of abuse.
  • Right to a limitation of processing: A restriction on the processing of your data may be requested:
    • If you're disputing the accuracy of your data for a time period allowing us to check whether those data are correct.
    • If your data has been processed in a way that is unlawful, but refuse to delete it and so request restrictions on the use of this information.

    - If we no longer need that information for the purposes set out above, but you continue to require it in order to meet legal requirements or if an objection has been lodged regarding processing of this data.

    7. Transfer of data to third parties

    Except where otherwise provided for, we will keep your personal data and not disclose or make them available to third parties:

    • In particular, if you express and sign an explicit agreement to provide certain confidential data for the purposes of a specific person.
    • In so far as data are requested by the Minister of Interior or a State Attorney, for the purpose of carrying out tasks within their competence.
    • If a court, attorneys, or a notary public requires the data for their proceedings, where the submission of such data is required in writing.
    • If the Tax Administration, the Croatian Pension Insurance Institute, and Croatian Health Insurance Fund require the data on the basis of the legal obligations that the controller has towards them.
    • In case we are required to provide data to the Ministry of Maritime Affairs, Transport and Infrastructure.

    8. Transfer of data to third countries

    Transfer of data to third countries (countries outside the EU) is performed only:

    • If the law provides for such an obligation
    • If it is essential that the transfer be carried out in order to fulfil contractual obligations
    • If you have given your express consent to this

    9. Use of digital services (website, applications)

    When you provide contact details, apply for a job or use the call forwarding service and fill in complaint forms on our official site, we are simply collecting any personal data that visitors willingly supply to us. Such data shall be kept confidential and used solely for the purposes of this purpose. Unless a legal obligation or order exists from an official body which allows that personal data to be communicated to the competent authority, there shall be no transfer of this personal data to any other entity. The website shall be accessed by means of a protocol, and technical information such as web traffic, the operating system that was used, display resolution, time of visit or amount of transferred data shall be recorded on this occasion.
